Terms and Conditions for 'AnimeEmotes.com'

 

1. Introduction

  • These Terms and Conditions govern your use of [AnimeEmotes.com] ("Custom Created Art") provided by KnightArtist86 ("us", "we", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

 

2. Use of the Service

  • The Service is for individual use only. You must not use the Service for any illegal or unauthorized purpose.

  • You agree to comply with all applicable laws, including copyright and intellectual property laws, while using the Service.

 

3. Purchase of Digital Art

  • Digital art products are non-transferable and non-refundable unless required by law.

  • Once purchased, you are granted a personal, non-exclusive, non-transferable license to use the digital art for personal purposes only.(includes streaming live,online videos and SocialMedia use)

4. Intellectual Property

  • All digital art and content on the Service are the property of [AnimeEmotes.com] or its content providers and are protected by UK and international copyright laws.

  • You may not reproduce, modify, distribute, or create derivative works of the digital art without our express written consent.

 

5. Payment and Pricing

  • Prices for our products are subject to change without notice.

  • Payment must be made in full before download or access to digital art is granted.

  • We accept payment via Credit/Debit Cards, Apple pay and Google pay.

 

6. Data Protection and Privacy

  • We are committed to protecting your personal information and privacy. Our Privacy Policy explains how we collect, use, and disclose your personal data.

 

7. Consumer Rights

  • Under the Consumer Rights Act 2015, if you are a consumer, you have the right to cancel your order within 14 days without giving any reason. This does not apply to digital content if you have started downloading or streaming it with our consent and you have been informed that you will lose your right to cancel once you do so.

 

8. Limitation of Liability

  • To the fullest extent permitted by law, we exclude all implied warranties and conditions.

  • We shall not be liable for any direct, indirect, incidental, special, or consequential damages, or any damages whatsoever arising out of or in connection with the use of the Service.

 

9. Termination

 

  • User Initiated: Users may request the deletion of their account at any time by contacting suppot@A. Upon receiving such a request, we will begin the process to deactivate and delete the user's account. Please note, account deletion is permanent and cannot be undone. All data associated with the account, including but not limited to, purchase history, personal information, and any user-generated content (unless otherwise specified), will be removed from our active databases. However:

    • Digital Art Purchases: Once you have purchased digital art from our site, you retain the right to use that art according to the terms under which it was sold. However, we will not maintain a record of these purchases after account deletion. It is your responsibility to keep backups of your purchased art.

    • User-Generated Content: If you have contributed content to public areas of the site (like reviews or comments), such content may remain visible to others even after account deletion, as it may not be feasible to remove all traces of this content from our systems or from backups.

  • Termination by Us: We reserve the right to terminate or suspend user accounts at our sole discretion for any reason, including but not limited to violation of these Terms of Service, fraud, or other illegal activities. Upon termination by us, we will notify you via the email address associated with your account (if possible), and you will no longer have access to our services.

  • Outstanding Balances: If there is an outstanding balance due to us at the time of a termination request, we will not process the account deletion until the balance is fully paid. You will retain access to your account for the purpose of settling any outstanding invoices. If payment is not received within 28 days from the termination request, we reserve the right to pursue collection of the debt through legal means and may restrict access to some or all services until payment is received.

  • Post-Termination Access: After termination, whether initiated by the user or by us, you will not have access to the website or any of its services through your account. If account deletion is requested and processed (after any outstanding balance is settled), we aim to complete this within 28 days from the request, but please understand that some information may persist in backups or for legal, regulatory, or administrative purposes.

  • Data Retention: We may retain certain data for a period after termination for legal obligations, resolving disputes, and enforcing our agreements, but this data will not be used for operational purposes.

  • Reactivation: Once an account is deleted, it cannot be reactivated. If you wish to use our services again, you must create a new account.

 

10. Governing Law

  • These Terms shall be governed and construed in accordance with the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

11. Changes to Terms

  • We reserve the right to update or change these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the new Terms.

12. Revisions Policy for Custom Art

 

  • Definition of Revision: A revision is defined as a request to alter or modify an existing custom artwork within the scope of the original concept provided by the customer. The modification must relate to details, such as color changes, minor adjustments in composition, or small additions or removals that do not change the fundamental nature of the artwork.

  • Scope of Revisions: Customers are entitled to up to 5 revision requests for free on each custom art piece, provided these requests do not deviate from the original concept of the artwork commissioned. For example, if the original request was for "a car crashing," revisions must remain within the theme and cannot be transformed into an entirely different subject, such as "a happy cat."

  • Unacceptable Revisions: Revisions that significantly alter the original concept or add entirely new elements that were not part of the initial request will be considered as new projects and will incur additional charges at our standard rate.

  • Requesting Revisions: Revisions must be requested within 14 days of receiving the initial artwork. Requests must be specific and clearly communicated to ensure that the artist understands the desired changes.

  • Final Approval: Once the customer has used their 5 revisions or indicates satisfaction with the artwork, no further free revisions will be accepted. The artwork is then considered final.

  • Additional Revisions: Should more than 5 revisions be necessary, or if the scope of the artwork changes significantly, additional revisions will be charged at a flat rate per revision to be agreed upon in advance.

  • Revision Limitations: We reserve the right to limit revisions if we determine that the changes requested exceed the boundaries of reasonable adjustments or if additional revisions would require extensive rework or new design concepts.

  • Payment for Revisions: If revisions exceed the free limit or change the scope of the original work, a new invoice will be issued before any further work begins. Payment for these additional revisions must be made in full before the changes are implemented.

13. Requesting art of Copyrighted Characters:

 

  • At AnimeEmotes.com, we respect intellectual property rights. If you wish to use or request copyrighted characters, it is your responsibility to secure the necessary permissions from the copyright holder. AnimeEmotes.com does not have the authority to grant permissions for the use of copyrighted content, nor can we be held liable for any legal consequences resulting from unauthorized use of such characters. Please ensure you comply with all copyright laws to avoid legal repercussions.

14. Commercial Use License for Custom Art

 

  • Purchaseable License: Customers have the option to purchase a commercial use license for any custom art. This license allows the use of the art in commercial projects, such as products for sale, marketing materials, or any other form of commercial venture where the art will be used to generate revenue directly or indirectly.

  • License Terms:

    • Non-Exclusive: The license granted is non-exclusive, meaning [AnimeEmotes.com] retains the right to use the artwork or license it to others.

    • Non-Transferable: The commercial license is non-transferable. It cannot be sold, traded, or given to another party.

    • Usage Scope: The license allows for unlimited commercial use of the artwork but does not include the right to sublicense or distribute the artwork independently from your commercial product or service.

  • License Fee: The fee for commercial use will be determined based on the intended use of the artwork, the scope of the project, and whether it's a one-time fee or a perpetual license. Details will be communicated before any purchase.

  • Rights and Restrictions:

    • Customers purchasing this license may incorporate the artwork into their commercial products or projects without further royalties or permissions needed from AnimeEmotes.com.

    • The artwork must not be resold or redistributed as stock art, digital or print downloads, or in any way that suggests the customer owns the copyright of the original artwork.

  • Duration: The commercial license is perpetual unless otherwise specified in the license agreement. However, this does not include the right to use the artwork in perpetuity if it violates copyright or trademark laws in the future.

  • Modification: Customers may modify the artwork for their commercial use, but any modified versions remain under the same terms of this license.

  • Legal Compliance: It's the customer's responsibility to ensure that the use of the artwork complies with all relevant laws, including but not limited to copyright, trademark, and privacy laws in their jurisdiction.

  • Purchase Process: To purchase a commercial license:

    • Contact our sales team or use the licensing form on our website to request a quote based on your specific needs.

    • Upon agreement, payment must be made in full before the license is issued.

  • Cancellation: Once a commercial license is purchased, it cannot be canceled, and no refunds will be issued unless the artwork fails to meet the agreed-upon specifications or if there's a legal reason prohibiting its use.

15. Custom Art Requests and Decline Policy

 

  • Acceptance of Custom Art Requests: AnimeEmotes.com welcomes custom art requests and strives to fulfill them to the best of our abilities. However, we reserve the right to accept or decline any request for custom art at our discretion.

  • Decline Criteria: Custom art requests may be declined if they:

  • Infringe on Copyright or Trademark: Requests that include or closely resemble copyrighted or trademarked content without proper authorization.

  • Unlawful Content: Requests that depict or promote illegal activities, violence, hate speech, or any content that could be considered unlawful or harmful under UK law or international standards.

  • Excessive Complexity or Impracticality: Requests that are technically impossible, excessively complex, or beyond the scope of our current capabilities.

  • Ethical Concerns: Requests that violate our ethical standards or could potentially harm reputations or individuals.

  • Inappropriate Content: Artwork that is deemed inappropriate, offensive, or unsuitable for our portfolio or brand image.

  • Notification: If your custom art request is declined, we will notify you via email or through our platform with an explanation. We will not disclose the reason for decline if it involves sensitive or legal matters unless required by law.

  • Non-Disclosure Agreement (NDA): For sensitive projects, clients may be required to sign an NDA before we review or accept a request. This ensures that any information shared remains confidential.

  • Refund Policy: If a request is declined after payment has been made but before work has started, a full refund will be issued to the method of original payment.

  • Future Submissions: Clients whose requests have been declined are welcome to submit revised requests that address the reasons for decline, though repeat declines may result in future requests being automatically rejected without review.

  • Final Decision: The decision to decline a request is final and at the sole discretion of AnimeEmotes.com. We are not obligated to provide detailed reasons beyond what is legally required or what we deem appropriate to share.

  • Alternative Solutions: Where feasible, we may offer alternative solutions or suggest modifications to the request to align with our policies and capabilities.
